TERMS AND CONDITIONS

This agreement constitutes a legally binding contract governing all service orders and product sales between the Bride and Groom and The Photographer, Philibert Barelli, Chemin Vermont 4, 1006 Lausanne.
The Photographer reserves the right to amend these terms and conditions at any time. Each order shall be subject to the terms and conditions in effect on the date of the order.

Article 1: Purpose

Philibert Barelli provides private and public photographic services as detailed on its website: https://www.philibertbarelli.com.
Booking a photography wedding service by the Bride and Groom constitutes an order and implies their unconditional acceptance of these terms and conditions, unless otherwise agreed upon by the Photographer and the Bride and Groom in writing.
All documents other than these terms and conditions, including catalogs, brochures, advertisements, or notices, are for informational purposes only and are not part of this contractual agreement. These terms and conditions are integral to the service contract signed by the Bride and Groom.

Article 2: Order

Photographic service bookings can be made exclusively via email, telephone (using the contact information provided on the photographer's website), or through the customer interface on the client portal.
All orders are considered accepted upon receipt of the required deposit and must be confirmed with a signed contract that includes all relevant details (e.g., date, location, etc.). Contracts can be signed online through the client portal or returned to the Photographer via email.
Failure to make the deposit payment and sign the contract within 7 days of receiving the contract from the Photographer will result in the Photographer not guaranteeing the reservation of the date.

Article 3: Prices and Payment Terms

Prices are inclusive of all taxes and are based on the rates in effect at the time of the order. Any services that have been booked will be charged at the rate in effect at the time of booking.
Estimates provided by the Photographer are valid for 7 days.
A 50% deposit is required to confirm an order, which can be paid via bank transfer or online payment. The deposit signifies a firm and irrevocable commitment, and no cancellations will be accepted, except in cases of force majeure as defined below.
The balance must be settled within 10 days after the wedding date, prior to the delivery of the initial photos to the online gallery. Failure to complete the balance payment will result in the cancellation of photo delivery, with no refund of the deposit. Final photo delivery is contingent upon full payment. The final payment amount may be adjusted for additional options, such as extra hours, which will be billed separately, subject to the Photographer's availability.

Article 4: Travel, Accommodation, Meals, and Expenses

Travel expenses (by plane, boat, or car) and accommodation expenses shall be covered by the Bride and Groom.
Car travel costs are calculated at a rate of EUR 0.80 per kilometer.
If air travel is necessary, the Photographer will book the flight in advance and may request an additional deposit to cover booking expenses.
Accommodation for the Photographer, depending on the location, should be mutually agreed upon between the Bride and Groom and the Photographer based on the distance to be traveled.
The Photographer requests at least one hot meal, regardless of the chosen photography collection.
If the service location changes or is not precisely defined at the time of contract signing, the Bride and Groom will be responsible for covering any resulting expenses. Additionally, the Bride and Groom shall be liable for any additional charges (e.g., access fees, paid parking) upon presentation of receipts by the Photographer.
In the event that the Photographer, with the prior consent of the Bride and Groom, is required to extend their service hours beyond the scope defined in this contract, each additional hour will be billed at EUR 300.- per hour. Billing is done for each started hour, and additional hours will be invoiced separately, to be paid prior to photo delivery to the online gallery.

Article 5: Change of Service

The Bride and Groom may choose to upgrade to a higher collection, but downgrading is not permitted. Such changes must be made at least two weeks before the wedding date by signing an amendment to the contract. A certificate will be provided upon request for any service upgrades.

Article 6: Force Majeure

In the event of unforeseen circumstances, such as natural disasters, war, acts of terrorism, strikes, or other events beyond the control of the parties, the Photographer may be unable to fulfill their obligations. In such cases, the Photographer will make reasonable efforts to provide a substitute photographer or reschedule the service. If this is not feasible, both parties shall be released from their contractual obligations, and the deposit will be refunded in full. However, no additional compensation or damages will be provided.

Article 7: Copyright and Usage

The Photographer retains all copyright and intellectual property rights to the images captured during the wedding photography service. The Bride and Groom are granted personal usage rights of the images for personal, non-commercial purposes. Any commercial use of the images requires prior written consent from the Photographer.

Article 8: Client Cooperation

The Bride and Groom shall provide reasonable cooperation to the Photographer, including but not limited to providing access to necessary locations and ensuring the presence of individuals for group photographs. The Photographer is not liable for any missed shots due to the Bride and Groom's failure to provide such cooperation.

Article 9: Photo Delivery

The Photographer will deliver the final photos in a digital format to the online gallery within 6 weeks. The online gallery will be accessible to the Bride and Groom for a lifetime. Photos will be available for unlimited downloads. Every packages includes all the prints and one album to preserve the Brides and Groom’s heirloom. Article 10: Dispute Resolution

Any disputes arising from this agreement shall be resolved amicably through negotiation between the parties. In case of unresolved disputes, legal action may be pursued in accordance with applicable laws and regulations.

Article 11: Applicable Law and Jurisdiction

This agreement shall be governed by the laws of Switzerland and any disputes shall be subject to the exclusive jurisdiction of the courts in Lausanne, Switzerland.
By booking our services, the Bride and Groom acknowledge that they have read, understood, and agreed to these terms and conditions. This agreement supersedes all prior understandings and constitutes the entire agreement between the parties.
